NO OBJECTION CERTIFICATE :

The Water (Prevention and Control of Pollution) Act 1974 has under provisions of section 25.1 (a) imposed restrictions on new outlets and new discharges. Under this provision no person shall take any steps to establish any industry or process without the consent of the State Pollution Control Board. See Section 25.1 (a) for details.

Section 21 of the Air (Prevention and Control of Pollution) Act also puts a similar restriction and, no person shall without the previous consent of the State Pollution Control Board establish any industry. Non compliance is a punishable offence.

To facilitate that all development projects have made adequate plans and provisions for pollution control and also to ensure that industries do not discharge untreated effluents/emissions into the environment and that the project site is adequate from the environmental angle, the State Pollution Control Board considers applications for grant of No Objection Certificate from the pollution angle.

While the No Objection Certificate helps the industry on one hand to comply with its legal obligations, on the other hand it facilitates the industry to get other clearances from Banks, the Industries Department, Financial Institutions and also from the Ministry of Environment and Forests under the Environmental Impact Assessment Notification of 1994.

The application form for a No Objection Certificate can be obtained from the offices of the Board. The application form has to be accompanied with details on the manufacturing process, measures proposed for air and water pollution control, safety and on site disaster management plan (in case of hazardous industries), Environmental Impact Assessment reports, Environmental Management plans etc. You have consultants to guide you through these and other areas.
